| Liberty Wednesday, May 26, 2010: 6:21 pm More from Liberty | This is an embarrassment to the county. Now, Page two. Mr Walters is entitled to just compensation. Facts, After the county deemed his items theirs, they did not take possession of them. Their mistake was Mr Walters was left, still in possession of these items by the county. Since they did not claim them by taking possession of them but instead left them in the possession of Mr Walters, he had very right to pull them where ever he wanted to pull them as long as he maintain possession and did not transfer them to another party. Period. His arrest was false and instigated by a hyper and out of line Barney Hale. The Deputy Sheriff Scott Nay who falsely arrested him should have used better judgment and checked with the prosecutors office first. Because according to the court order his arrest wasn't legal and Mr Walters needs to take action against the county for the false arrest and compensation for the illegal use of his property and all legal fees. Also since Barney Hale took ownership of Mr Walters items but didn't take possession of them and left them ( rent free ) on Mr Walters property instead, Mr Walter is due just compensation and rent for storing Barneys stuff. Also Mr Walters is due rent for county use of his property to hold their auction on. The mistake the Judge and Barney and his Deputy made was they took ownership of his stuff but they didn't take the property it sat on. And left them in the possession of Mr Walters so as long as he kept possession no crime was committed. That's why real police have to take criminal law when getting the criminal justice degrees. Instead of Barney sitting across the street with a set of binoculars aching to make a citizens arrest he should have remove his newly acquired ( stolen) goods from the property and taken them to the county's property to auction. The Constitution protects ones property from being commandeered ( used ) by the government except in time of war and even then only with due compensation. Since the Items wasn't removed from Mr Walter possession ( where the Judge left them ) then Morgan County Prosecutor Steve Sonnega can't make formal charges for a crime that wasn't committed. Just ask the prosecutor, after his review, he won't charge him. The poor old man that Barney had Nay misuse his authority on said it best below after having his evening of fishing interrupted by someone with only one bullet in his gun. Mr Walters said: “How do you charge someone with taking their possessions from their own property?” Morgan County Deputy Sheriff Scott Nay realizing his mistake said, “per Judge (Matthew) Hanson’s request, that I place Mr. Walters under arrest for theft". The Judge basically called the deputy a lier by reporting and I paste: "Judge Hanson said Monday that he left charging Walters up to the deputy. The judge said he did not tell the deputy to charge him." Humm....Deputy and Judge running scared ? Now pointing fingers at each other ? Mr Walters needs volunteer legal help by someone who will take a part of his reward as payment. . What another embarrassment for this county. I guess it's one-a-day now. We need new leadership fast. I'm told our new Sheriff won't put up with this kind of stuff. . . |

Just want to make it clear in my last post that I'm not saying that anyone especially the Judge lied but the deputy's statement contradicts the Judge. Both of who are doing their jobs and in my opinion have been caught up in a silly action by a county employee. |

| Liberty Wednesday, May 26, 2010: 9:54 pm More from Liberty | Great post John, I hope the paper follows through and helps this guys plight by exposing the abuse of an out of control and over zealous county employee and others who can't explain the constitution or say no to him. This is now starting to become the problem of the county commissioners. I liked how the paper sought his interview at the jail. I hope the paper could get more in the future because just because someone refuses to respond to the government that's not grounds for the government to attack any citizen and commit the crimes they did against this man. If anyone know of a lawyer that would take his case they should drop them a line. I think the county really messed up and have themselves in a very bad hole. Instead of doing the right thing an putting a stop to this they just keep shooting themselves in the foot. I understand more and more why someone like Danny Stewart constantly tries to clean the counties leadership up. He does it for us and our reputation that stuff like this hurts so badly. . . |

The only concern I have is that there are people who work in political offices in this county who think that they have the power to remove items (junk or not) from someone’s property without consent. Despotism. I also don’t care about how many laws or ordinances they have written to enable them to do such cruel acts. It makes me sick. Leave people alone. Let them pursue happiness in their own way. He wasn’t hurting a single sole. If you don’t like looking at his yard, close your eyes. If you have an eyesore, use an antibiotic.
