New state laws mean changes for many people beginning today

| downtown customer Thursday, July 1, 2010: 6:52 pm More from downtown customer | Bray should have been shocked sooner. Ask any custodial parent in Morgan County how easy it is to collect child support. Impossible. Nothing is every done and even divorce settlement is never enforced. It costs hundreds of dollars for one parent to take the other to court and no judgement is enforced. The one ordered to pay skips the state or works for cash, or does not work at all. Jail, license suspension or Federal tax collection is usually never enforced leaving the other parent to support the child on her own while the father gets off free. One father I know may think he is free but I believe it is still 10 years for collection after the child is of age. Surprise! Surprise! |

That's not true. My ex husband moved out of state, did not pay the support that was agreed upon in our court papers, and all the mother (or father, as is sometimes the case) has to do is go to their local Child Support Enforcement office. I did that, and they located him and started garnishing his wages, and intercepted his tax refund. Yes, it can be and will be enforced, but the custodial parent has to be willing to actually do something besides whine and complain that they're not getting their payments. There is a minimal fee (I think it's $25 in Morgan County) for getting the Enforcement office involved, but that fee is waived if the children receive Medicaid. And I also have to dispute you on the cost of one parent to take the other to court...I've taken my ex to court twice...once over custody, and once over child support, and it didn't cost me a dime. All I did was send a letter to the judge requesting a hearing. (However, the cost for an attorney would make it expensive...I didn't bother with an attorney. They can't do anything I can't do as far as my kids are concerned). |
| Step Up Friday, July 2, 2010: 2:22 am More from Step Up | Stingersbaby...well stated and factual response. The Child Support Enforcement folks in the Morgan County Prosecutor's office are quite successful in collecting child support arrearages. Those who have the ability to pay and fail to do so find themselves behind bars frequently. It would behoove that office to more effectively inform the public of their services. |
| downtown customer Friday, July 2, 2010: 9:03 am More from downtown customer | Sorry StingersB.In defense of My daughter she was not on welfare, had money, but did have to spend for a local lawyer to go to court several times. She managed to get some money until ex did leave the state. She even hired a detective to keep track of him. Finally she just got so disgusted with all the problems she just gave up. She was told if he paid Federal taxes they would confiscate that. She did not see any of that money. You are one of the lucky ones. It has been at least 2 years since any money came in. The dependent is now of age. She did not sit and whine but went on with her life and her childs. Her ex had no visitation rights and did not even want rights. Don't judge others by how your case was taken care of. |
| concerned parent Friday, July 2, 2010: 12:21 pm More from concerned parent | I agree with downtown customer. It might work if everyone lives, works and has their divorce in Morgan County but cross that county line and you are screwed. I have seen it take many years to catch up with the other parent and that only is for the support not for the added expenses like splitting book rentals etc... |
| LilaMae Friday, July 2, 2010: 12:53 pm More from LilaMae | Stingersbaby you were one of the fortunate ones. I on the other hand knew where the father was, provided SS#, address and place of employment, paid my money to have Child Support Enforcement go after the dad. NOTHING was ever done. The excuses were constant and many. When my son turned 18 years of age, I received a court document in the mail stating "case had been closed due to lack of information". Through all of my efforts I was able to collect $75.00 total over the course of 18 years. Gotta love those government offices that constantly defend their actions by saying you didn't do anything for them in order to get the job done! Please! |
| downtown customer Friday, July 2, 2010: 1:49 pm More from downtown customer | Thank you Lila Mae and Concerned parent. After the other comment I began to think somehow my daughter did not do everything possible. Even the final settlement she was told she would have to hire another lawyer. She did what was required, counseling etc. He skipped out. She took what she could and let the rest go. She saw no final school expenses etc. at the end of each year. Everything was filed in the Morgan Co. Court. She would become ill everytime she had to take him to court so just went on with her life instead. It seems the judges sometimes are on the fathers side even though they are not the custodial parent the men get the sympathy. |
