The first Amendment protects distributors of political literature for pretextual arrests for littering. In Schneider vs. New Jersey, 308 U.S. 147 (1939) the court said: We are of the opinion that the purpose to keep the streets clean and of good appearance is sufficient to justify an ordinance which prohibits a person rightfully on a public street from handing literature to one willing to receive it. Any burden imposed upon the city authorities in cleaning and caring for the streets as an indirect consequence of such distribution results from the constitutional protection of the freedom of speech and press. |

The US Postal service should have to stop passing out all the other flyers and junk mail/Trash. We say we want to be a green nation, yet the USPS pass out millions of pieces of junk mail a day and dont give us the right to opt out. I say Fine them! The USPS is the biggest litter bug out there!! If this guy was passing out free gas coupons nothing would be said. Its only because of the content he is passing out that is a problem!!!
