I can understand your support for the mother who, as legal guardian, used the money that the courts intended for her children for the entire family instead. I'm sure that the money she received as the wife was used for the children too. But don't come down on the Reporter. If they declined to report court proceedings because the act being reported on was just a mistake, in the eyes of the offender or supporters, there would be very little news. "Good" people sometimes commit crimes and make mistakes. I don't think you would want the Reporter to sift every potential story through a process to determine if the person was deserving of a pass. As I read the original story, I didn't see a slant that put the mother in a particularly harsh light, I didn't see descriptive adjectives ewhen describing her, no value judgments made, just facts and quotes. The story is news because what went on is a matter of public record. Court proceedings are for us to know about. Now, when an adut is made guardian over a pot of money that has been awarded to a minor, it is because the minor is judged by the court to not have the maturity to make decisions on the use of that money. Trust guardians are to use the money for the minor, with some allowances for administration expenses that the guardian can claim by providing the requisite explanation. Beyond that, none of the money is to be used for the benefit of other persons, including the guardian. That status remains until thge minor is of legal age. At that time, all of the money not used directly for the minor's benefit, less approved administrative expenses should be there for the person for whom the money was intended. Yes, it would be a mistake to use the money for other purposes. But that would be a mistake that would violate a legal responsibility. That would be news. If, when there has been an investigation and subsequent court action, there turns out to be no violation, then we can all be happy. But many "news" stories report on the information of the day before any final determination. "People of interest" are named in criminal investigations. The crimes are reported even before we know who did the crimes. This is how news is made. |

Everyone agrees that what she did was wrong, and that her child is the one that suffers from it. I just don't think it should have made front page news. Alot of other people in this town have done far worse and you never see those things on the front page. |

As Nobody stated, this was a criminal act and these sorts of stories are in the news all the time. For some reason alot of you are upset about this one, acting as if she is being victimized by the paper for reporting it. However, I too agree that all the crime investigations from the sheriffs dept. should also be in the news too. |

My question is to the courts as to why this wasnt set up as a trust. The mother was given a lump sum along with the two daughters. If indeed guardianship was fit to be neccessary the courts still required approval which was only done for $16,000? Where were the courts to oversee that it was done for every withdraw? Why did the investor release the money if permission was needed? And shame on the mother for withdrawing money no permission and clearly knowing she was doing wrong. We all have responsibilities as parents and with that comes expenses. That money was for their future not to be used for the things we as parents are supposed to pay for. Being appointed as a guardian means you are the protector the one to over see and make decisions in the best interest of the child. Not blowing it on vacations to keep up with a familiar lifestyle . As for the eldest daughter from information that I know from the past when the original inheritance was 408 And invested for 12 years and only walking away with slightly more than what was given my question is where's the interest? Aside from the economy which would have been around 2004 and only gaining a VERY small amount........I find that pretty suspicious myself. I would like to bet there was not an investigation on the eldest daughters money considering statute of limitations is 2 years....expired 5 years ago. I'm calling that hearsay because the investigation was red flagged for the youngest. Media is dispicable at times. I can handle facts not assumed information. I will give the mother the fact that the bankruptcy crap or things that don't have to do with the case were uncalled for. Prayers to the daughters and family. Todd deserves this justice whether the mother and daughter have made amends or not. |
