The first, as an employee, the second as a "contract employee." It makes no difference that Mr. Hale is under contract, he is an employee. The law is about conflict of interest and we should not lose sight of that. To say that Mr. Hale would have a conlict of interest as an employee but not as a contracted employee is utterly insane. If Pete Foley is the attorney I think he is, he will advise Mr. Hale that he has a conflict of interest and that he shouldn't be trying to wiggle through a teeny definition loophole. |

The fact is that they are employees either way. Sounds like it's time Kenny got a real job or gave up his political career. Kenny, don't make one of us sue you to do the right thing. Kenny claims he is not an employee, therefore, shouldn't he be responsible for the legal fees that will be generated by Pete Foley to do the research necessary to give Kenny an opinion of his personal situation? I would bet almost anything Kenny expects the taxpayers to pick up the tab. I guess the legal fees submitted to the county by Mr. Foley are public information. I challenge him to single those charges out on his billing statement so we can see who pays them. |

You contract with someone or some entity to do work that would otherwise be done by a paid employee. But it is also a way for employers to do a couple things. One is to avoid paying benefits. Another is to show the person that the employer doesn't desire to commit to a relationship....the "outs" are more plentiful with contracted employees. But in the business world, you don't frequently put a contracted person in the top position, give them power over budgetary decisions, and give them employee-like titles. Whe it walks like a duck....... |
